Goodwill pays workers with disabilities as little as 22 cents an hour

In 2011, the multibillion-dollar nonprofit Goodwill Industries paid Pennsylvania workers with disabilities wages as low as 22, 38 and 41 cents an hour, according to Labor Department records obtained by NBC News. In 2010, an Applebee’s in a tony New York suburb hired hearing and visually impaired employees through a placement program with the Helen Keller National Center and paid them between $3.97 per hour and $5.96, well below the state minimum wage of $7.25.And it’s perfectly legal due to a Depression-era loophole in federal labor law, as NBC reports:

Section 14 (c) of the Fair Labor Standards Act, which was passed in 1938, allows employers to obtain special minimum wage certificates from the Department of Labor. The certificates give employers the right to pay disabled workers according to their abilities, with no bottom limit to the wage… The non-profit certificate holders can also place employees in outside, for-profit workplaces including restaurants, retail stores, hospitals and even Internal Revenue Service centers.

While employers like Goodwill defend the practice as providing jobs to people who need and want them, disability and labor rights advocates have called the loophole exploitative, saying it traps workers in a “two-tiered” system that says “Americans who have disabilities aren’t as valuable as other people,” as Marc Maurer, president of the National Federation of the Blind told NBC. “That’s wrong. These folks have value. We should recognize that value,” he added.

A bill currently being considered in Congress could repeal Section 14 (c) and mandate employers fairly compensate all workers, but it has faced fierce opposition from trade associations representing employers who benefit from the loophole. “Meaningful work deserves fair pay,” bill sponsor Rep. Gregg Harper, R.-Miss., told NBC. “This dated provision unjustly prohibits workers with disabilities from reaching their full potential.”

Meet Zimmerman Murder Trial Juror B-37 (AKA, The Parrot Lady)

Six jurors have been picked to decide George Zimmerman’s fate in a Seminole County, Florida court. All six are women; at least four are mothers. Five are white and one is a woman of color (somehow, in a case that’s central to the way we think about racial justice, no one seems to be exactly sure whether she is black or Latina). Four alternate jurors have also been chosen, and can step in if needs be.

One juror in particular, known as B-37, is white, and the mother of two children. But she also cares for other life forms. During the publicity phase of questioning, B-37 assured attorneys that the media coverage around Trayvon Martin’s death and subsequent protests wouldn’t taint her duty as a potential juror because newspapers in her home are only used to line her parrot (or parrots—that remains unclear) cage.

Aside from the parrot or parrots, B-37 also cares for a crow with a missing wing. And three dogs. And four cats. Oh, and two lizards. Orlando Sentinel court reporter Jeff Weiner, who has been live tweeting from the courtroom, assures us that the so-called Parrot Lady is one of six jurors on the case.
