North Carolina Governor Signs America’s Worst Voter Suppression Bill Into Law

voteOn Monday, North Carolina Gov. Pat McCrory (R) signed into law a massive voter suppression bill compiling numerous different provisions used to restrict voting in other states. Among other things, the bill includes a strict voter ID law, which will reduce turnout among minority, low-income and student voters. It will cut a full week of early voting, which is likely to depress turnout among low-income and African American voters. And it will prohibit certain kinds of voter registration drives, which tend to register low-income and minority voters.

Students, low-income voters and racial minorities, of course, tend to vote for Democrats. McCrory, and the lawmakers behind this bill, are Republicans.

John Roberts has a way of inserting himself into almost every political setting. He upstaged Barack Obama at his first Inauguration; he made his the most important single vote cast in the 2012 election; he has upended 2014 politics with his opinion gutting the Voting Act. Now it turns out he has assumed a key role in the War on Terror.

So it seems entirely reasonable for The New York Times’s Linda Greenhouse to suggest that “we have given the chief justice — any chief justice, not just this one — too much to do.”

The question is being raised now because recent leaks give us a disturbing look the secretive Foreign Intelligence Surveillance Court. The chief justice selects the 11 district judges who serve on this court; his discretion is subject only to a few limits: the judges must come from at least seven appeals-court circuit, one must be a district judge of the District of Columbia, and no fewer than three must live within 20 miles of D.C. The FISA panel was originally conceived as simply a mechanism to grant warrants for surveillance — the equivalent of a magistrate who looks at an affidavit from a police officer and then orders a search or seizure. If you know about foreclosure fraud, the mass fabrication of mortgage documents in state courts by banks attempting to foreclose on homeowners, you may have one nagging question: Why did banks have to resort to this illegal scheme? Was it just cheaper to mock up the documents than to provide the real ones? Did banks figure they simply had enough power over regulators, politicians and the courts to get away with it? (They were probably right about that one.)

A newly unsealed lawsuit, which banks settled in 2012 for $95 million, actually offers a different reason, providing a key answer to one of the persistent riddles of the financial crisis and its aftermath. The lawsuit states that banks resorted to fake documents because they could not legally establish true ownership of the loans when trying to foreclose.

This reality, which banks did not contest but instead settled out of court, means that tens of millions of mortgages in America still lack a legitimate chain of ownership, with implications far into the future. And if Congress, supported by the Obama administration, goes back to the same housing finance system, with the same corrupt private entities who broke the nation’s private property system back in business packaging mortgages, then shame on all of us.

So the paranoid hippie pot dealer you knew in college was right all along: The feds really were after him. In the latest post-Snowden bombshell about the extent and consequences of government spying, we learned from Reuters reporters this week that a secret branch of the DEA called the Special Operations Division – so secret that nearly everything about it is classified, including the size of its budget and the location of its office — has been using the immense pools of data collected by the NSA, CIA, FBI and other intelligence agencies to go after American citizens for ordinary drug crimes. Law enforcement agencies, meanwhile, have been coached to conceal the existence of the program and the source of the information by creating what’s called a “parallel construction,” a fake or misleading trail of evidence. So no one in the court system – not the defendant or the defense attorney, not even the prosecutor or the judge – can ever trace the case back to its true origins.

On one hand, we all knew more revelations were coming, and the idea that the government would go after drug suspects with the same dubious extrajudicial methods used to pursue terrorism suspects is a classic and not terribly surprising example of mission creep. Both groups have been held up as bogeymen for years, in order to scare the public into accepting ever nastier and more repressive laws. This gives government officials another chance to talk to us in their stern grown-up voices about how this isn’t civics class, and sometimes they have to bend the rules to catch Really Bad People.

On the other hand, this is a genuinely sinister turn of events with a whiff of science-fiction nightmare, one that has sounded loud alarm bells for many people in the mainstream legal world. Nancy Gertner, a Harvard Law professor who spent 18 years as a federal judge and cannot be accused of being a radical, told Reuters she finds the DEA story more troubling than anything in Edward Snowden’s NSA leaks. It’s the first clear evidence that the “special rules” and disregard for constitutional law that have characterized the hunt for so-called terrorists have crept into the domestic criminal justice system on a significant scale. “It sounds like they are phonying up investigations,” she said. Maybe this is how a police state comes to America: Not with a bang, but with a parallel construction.

The Baltimore Orioles pummeled the San Francisco Giants 10-2 Sunday afternoon, but all was not well for one Orioles player. After the game, O’s star Adam Jones tweeted that a San Francisco fan tossed a banana at him while he was playing centerfield during Sunday’s game.

There’s no video of the incident, but it seems improbable that Jones, who is black, would make it up out of thin air. The Giants said they didn’t hear reports during the game but will investigate video footage of the final inning to verify Jones’ claim.

Banana-throwing is still maddeningly common in sports like European soccer, but such explicit displays of racist behavior are largely absent from American games now. That’s obviously a good thing, but while we can’t stop every idiot fan who wants to do something stupid, we also shouldn’t allow the rarity of incidents like this to obscure the fact that racism toward black athletes still manifests itself in different ways quite often. After Jones tweeted about the incident, for instance, Twitter users questioned whether it was racially motivated or if it was just regular heckling, as if bananas are common ballpark cuisine along the lines of beer, sunflower seeds, and peanuts.
